Membership Terms

Effective Date: July 2026

By purchasing a membership to Chez Mamie (the "Company"), you (the "Member") agree to the following terms and conditions on behalf of yourself, your household, and any guests or caregivers you bring to the Company. Operational details — including hours, pricing schedules, play space rules, and programming — are governed by the Company, which is incorporated by reference and subject to update without requiring re-execution of these Terms.

1. Membership & Dues

1.1 Membership Tier & Pricing

Chez Mamie offers single-household membership tiers: Single child (1 child) or Family (2 or more children). Monthly dues are as stated in your enrollment confirmation. Founding Members receive 20% off their monthly membership rate for the lifetime of continuous membership, plus early access to events and priority booking. Founding status is non-transferable and requires a 12 month commitment.

1.2 Member Benefits

Active membership includes: unlimited play access during operating hours; guaranteed entry subject to overall Company capacity; and 15% discount on all café and retail purchases.

1.3 Member Cap

Active memberships are capped to preserve the Company's atmosphere. Once capacity is reached, prospective members will be placed on a waitlist. Waitlist mechanics are governed by Company policy as posted at chezmamiecafe.com. Memberships are non-transferable.

1.4 Price Adjustments

Chez Mamie, LLC reserves the right to adjust membership dues with a minimum of 30 days' written notice by email. Members who do not wish to continue at the revised rate may cancel pursuant to Section 2.

1.5 Operational Changes

The Company reserves the right to modify operating hours, programming, play areas, events, staffing, access policies, and other operational matters at its discretion. Temporary closures for maintenance, repairs, private events, holidays, or other business purposes shall not constitute a breach of these Terms.

2. Billing, Cancellation & Pause

2.1 Automated Billing

Dues are billed automatically on the 1st of each calendar month via the payment method on file. By enrolling, you authorize Chez Mamie, LLC to charge your payment method on this recurring schedule.

2.2 Failed Payments

If a charge fails, the system will retry after 48 hours. If payment is not secured by the 5th of the month, the membership will be automatically suspended and the slot may be offered to the next waitlisted household.

2.3 Cancellation

You may cancel at any time by written notice to member@chezmamie.com, received at least 14 business days before the 1st of the following month. No prorated refunds are issued for mid-month cancellations. Upon cancellation, the membership slot is forfeited. Re-enrollment is subject to waitlist availability.

2.4 Membership Pause

Members may request one (1) pause of up to 30 days per calendar year by written request to member@chezmamie.com at least 14 business days before the next billing date. No dues are charged and Company access is suspended during an approved pause. The Company may decline a pause request where operational constraints require it.

3. Supervision, Conduct & Health

⚠ Chez Mamie is not a daycare, childcare facility, or drop-off center. At least one adult member or approved caregiver must remain on the premises at all times. Children may never be left unattended anywhere in the Company.

3.1 Adult Supervision

At least one (1) adult member or approved caregiver must actively supervise all children in the Member's party at all times. Company staff are not responsible for supervising children.

3.2 Conduct Standards

Members are responsible for ensuring their children and guests conduct themselves in a manner consistent with the safety and comfort of all guests. The Company reserves the right to ask any member, guest, or child to modify behavior that endangers others or disrupts the Company's atmosphere. Repeated failure to comply may result in membership termination under Section 5. “Repeated failure” means two or more documented incidents within a 12-month period, as recorded by Chez Mamie staff. A written or electronic notice will be issued following the first incident. Termination may follow a second incident at Chez Mamie's sole discretion.

3.3 Illness Policy

Any child or adult displaying visible symptoms of illness, including fever, cough, nasal discharge, vomiting, diarrhea, or unexplained rash, will be asked to leave the premises. A child must be symptom-free for 24 hours before returning. This policy is applied consistently and without exception.

3.4 Food and Beverage

Beverages in closed lidded containers are permitted in designated seating areas adjacent to play zones. Hot beverages and open containers are not permitted inside play zones or on play surfaces. With the exception of a water bottle, children must keep all food and drink outside the play zones. Chez Mamie is not responsible for spills, stains, or injuries resulting from food or beverage in play areas.

3.5 Alcohol and Supervision

Adults consuming alcohol remain solely responsible for supervising children in their care. Consumption of alcohol does not transfer supervisory responsibilities to the Company or its staff. The Company reserves the right to refuse alcohol service to any person and to remove any guest who appears intoxicated, impaired, or unable to adequately supervise children in their care.

4. Liability Waiver & Indemnification

4.1 Activity Waiver Requirement

A separate Activity Waiver & Release of Liability is required for each child prior to their first visit. The Activity Waiver must be completed via the Company's digital intake system before the child accesses the play areas. The Activity Waiver is incorporated into these Terms by reference. Failure to complete the Activity Waiver will result in denial of play area access.

4.2 Indemnification

The Member agrees to indemnify, defend, and hold harmless Chez Mamie, LLC, its owners, officers, managers, employees, and agents from claims, damages, or liabilities arising from (i) the Member's violation of these Terms, (ii) the negligent or intentional acts of the Member, the Member's children, or the Member's guests, or (iii) property damage or personal injury caused by the Member, the Member's children, or the Member's guests.

4.3 Property Damage

The Member accepts financial responsibility for malicious or grossly negligent damage to Company fixtures, furnishings, play structures, or equipment caused by themselves, their children, or their guests. The Member shall be responsible for the reasonable costs of repairing, replacing, or professionally cleaning property damaged through the intentional misconduct or grossly negligent conduct of the Member, the Member's children, or the Member's guests. The Company may invoice the Member for such amounts and provide supporting documentation upon request.

5. Right of Termination

Chez Mamie, LLC reserves the right, at management's sole discretion, to suspend or terminate any membership immediately and without refund for:

  • Repeated failure to supervise children
  • Repeated or intentional violation of Company rules
  • Verbal abuse, harassment, or threatening behavior toward staff or other guests
  • Conduct that endangers the safety of children or other visitors
  • Any behavior that, in management's judgment, is inconsistent with the standards of the Company

Upon termination, membership access is revoked immediately and the slot is forfeited without refund and re-entry to the premises is subject to Chez Mamie's sole discretion.

6. General Provisions

6.1 Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Maryland. Any disputes shall be resolved exclusively in the state or federal courts of Montgomery County, Maryland, and both parties consent to personal jurisdiction therein.

6.2 Amendments to Terms

The Company may update these Terms with 30 days' written notice to active members. Continued membership after the effective date of any update constitutes acceptance. Operational policies may be updated at any time with reasonable notice posted at joinchezmamie.com.

6.3 Severability

If any provision of these Terms is found unenforceable, it shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

6.4 Entire Agreement

These Terms, together with the Activity Waiver, constitute the entire agreement between the Member and the Company regarding membership and use of Company facilities.

By completing digital enrollment, you confirm that you have read, understood, and agree to these Membership Terms and Conditions.
